High Court Allows Country Garden Danga Bay Sdn Bhd’s Applications to Strike out Purchasers’ Suit

CGDB also awarded costs for succeeding in their four applications

The High Court of Johor Bahru allowed all four striking out applications filed by Country Garden Danga Bay Sdn Bhd (CGDB) against the suit brought by the plaintiffs (purchasers) of the Danga Bay development.

The High Court’s decision in favour of CGDB, decided that the allegations of fraud and/or fraudulently misrepresentation to the purchasers and delivery of units which are different from the design agreed in their Sale and Purchase Agreements, disclosed as no reasonable cause of action against the developer; claims being frivolous and vexatious; and/or an abuse of process of the Court.

The purchasers’ claims on grounds of misrepresentation among others against CGDB are now struck out. The High Court also awarded CGDB costs for succeeding in their four applications. Country Garden Danga Bay Sdn Bhd was represented by Leonard Yeoh and Eri Fu while the purchasers were represented by Viola Decruz and Vinobha Anthony Doss.
